VitalStim has been ordered to post the following notice on its web site, by the United States District Court for the Eastern District of New York, alleging Lanham Act violations, antitrust violations, unfair competition, and other business torts.  The terms of the settlement are confidential. However, as a result of the settlement, DJO LLC (the parent company of the VitalStim entities) states as follows:

DJO wishes to clarify certain statements made previously about the use of (third party manufacturer) replacement electrodes with the VitalStim device.
While DJO does not recommend or approve the use of (third party manufacturer) electrodes with the VitalStim device, DJO has not conducted formal testing, establishing that (third party manufacturer) products are unsafe for such use.  At this time, DJO is not aware of any adverse events resulting from the use of (third party manufacturer) electrodes with the VitalStim device in the field. DJO is not aware that there is any legal prohibition on clinicians, therapists and administrators of VitalStim Therapy using (third party manufacturer) electrodes with their device, or that the use of (third party manufacturer) electrodes with the device would lead to the loss of such persons' medical licenses. Clinicians, therapists and other administrators of VitalStim Therapy must use their professional judgment in treating patients with dysphagia.

This makes the ELI Premium Ag+ the most advanced electrode on the market, delivering improved therapeutic results and greater patient comfort.  2 electrodes are conveniently pre-positioned on each butterfly shaped electrode patch.

Suggestion for Optimum Electrode Performance:
When using our ELI Premium Ag+ Electrodes, we've found that you'll have best results if you wrap the electrodes on the second and third uses. While our adhesive gel provides the lowest impedance and best dispersion available, any adhesive will lose effectiveness over time. On the first usage, our butterfly electrodes will perform excellently with no wrapping required. Wrapping on the second and third uses should prevent any problems due to lack of adhesion. The reason for this is, the VitalStim unit is designed to shut down if there is any sign of electrical circuit error - such as an electrode not making full contact with the skin. The new eSWALLOW USA Handheld Treatment Unit will not shut down under the same circumstances, so wrapping should not be required when using our unit. If you're using our new Solitary Plus Electrodes which provide more placement flexibility, due to the smaller surface area of the electrode, wrapping is suggested for all uses - first, second, and third.
